Thank you for using our website. This privacy policy (the “Policy”) applies to personally-identifiable information (“Personal Information”) that Tradewater, LLC, Tradewater Capital, LLC, Tradewater Holdings, Inc., Tradewater Well Services, LLC, Tradewater EGV, LLC, Tradewater (Thailand) Company Limited, and Tradewater International SRL (“Tradewater,” “we,” “us,” or “our”) collects online and offline, including via our websites at https://tradewater.co/https://refrigerantfinders.com/, and https://cnc.tradewater.us/ (collectively, the “Services”). 

Please read this Policy carefully to understand our policies and practices regarding Personal Information and how we will treat it. This Policy, together with the Terms of Use and the U.S. Supplemental Privacy Policy (the “Supplemental Policy”) posted on our websites, describes the types of information we may collect about you or that you may provide when you use our Services and our practices for collecting, using, maintaining, protecting and disclosing that information. 

This Policy, together with the Terms and Conditions and the Supplemental Policy posted on our websites, set forth the general rules and policies governing your use of our Services.  

Types of Personal Information We Collect 

  1. Identifiers, such as your name, postal address, e-mail address, or any other identifier by which you may be contacted online or offline.

  2. Financial Information, including bank account number, credit card number, debit card number, or any other financial information that does not allow access or withdrawal of funds.

  3. Characteristics of Protected Classifications under state or federal law, such as age, gender, and marital status.

  4. Commercial Information, such details of transactions you carry out using our Services and of the fulfillment of your orders.

  5. Internet or Other Network Information, such as IP address, device identifiers, browsing history, search history, and information regarding your interactions with our websites or advertisements.

  6. Geolocation Data, such as device location or any other location shared with us that is more granular than a city or town.

  7. Audio, Electronic, Visual, and Similar Information, such as call and video recordings.

  8. Professional or Employment-Related Information, such as work history and prior employer.

  9. Inferences drawn from any of the Personal Information listed above to create a profile or summary about, for example, an individual’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. 

Sources of Personal Information 

  • Directly From You. Tradewater collects information you provide to us when you use our Services or when you otherwise interact with us. For example, we collect the information you provide when you create a profile, post on our website, share images with us, purchase credits, or otherwise interact with us. This also includes information that you provide by filling in forms to use our Services, such as information you provide to us at the time of purchasing our carbon offset credits, signing up for and participating in our programs or features, and/or placing orders on our website. Types of Personal Information we may collect directly from you include your name, username and password, postal address, email address, phone number, and business contact information. 
  • From Vendors & Third Parties. Tradewater also collects Personal Information from our vendors and from third parties who disclose Personal Information to us.  
  • Via Cookies & Other Tracking Technologies. Tradewater collects Personal Information passively via cookies and other tracking technologies (“Cookies”). For example, we use Cookies to operate our website, analyze information about Users’ use of our websites, personalize our Users’ experience when they use our Services, and for marketing purposes, including through use of targeted advertising. This typically includes information about our website visitors, such as your IP address, the name of your operating system, the name and version of your browser, the date and time of your visit, and the pages you visit. The information we receive may depend on your browser or device settings. Among other Cookies, we use Google Analytics, a web analytics tool that helps us understand how visitors engage with our Services.   • To otherwise accomplish our business purposes and objectives;

  • If we believe disclosure is necessary or appropriate to protect the rights, property or safety of us or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. 

How We Disclose Personal Information 

We disclose the categories of Personal Information listed in the “Types of Personal Information We Collect” section, above, in the following contexts: 

  • To our Vendors. We disclose the Personal Information we collect to our vendors who act on our behalf. For example, we use vendors to operate our Services, process payments, and to help us with our promotional efforts. These vendors may need Personal Information about you to perform their obligations. We impose contractual limitations on our vendors’ use of Personal Information they collect in conjunction with providing services to us. 
  • To Third Parties for Marketing Purposes. We disclose Personal Information to third parties, including social media platforms and other advertisers, for marketing purposes. This includes disclosures of Personal Information via Cookies, as explained in more detail above and in our Supplemental Policy.

We will not attempt to re-identify the information, except that we may attempt to re-identify the information solely for the purpose of determining whether our deidentification processes satisfy applicable legal requirements. After it has been de-identified, the information is no longer Personal Information and is not subject to this Policy. We may disclose aggregated and/or de-identified information to our vendors and to third parties for our business operational purposes and for any other purposes permitted by applicable law.

Data Security 

The security of our user data is very important to us. We maintain reasonable and appropriate administrative, physical, and technological measures to protect the confidentiality and security of Personal Information we collect about you. Unfortunately, no website, server, or database is completely secure or “hacker proof.” We therefore cannot guarantee that your Personal Information will not be disclosed, misused, or lost by accident or by the unauthorized acts of others. 

European & United Kingdom Data Protection Law 

This section applies only to individuals who reside in the European Economic Area (“EEA”) or United Kingdom (“UK”) whose Personal Information is collected and used by Tradewater. 

For the purpose of applicable data protection laws in the EEA and UK, including the General Data Protection Regulation (2016/679) (“GDPR”) and the UK GDPR, Tradewater, LLC is the data controller of your Personal Information. Our Legal Bases for Using Your Personal Information 

We will only process your Personal Information when we have a valid legal basis to do so. Most commonly, we process Personal Information in the following circumstances:

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). 

Cross-Border Data Transfers 

We may transfer Personal Information to countries outside of the EEA or UK, which may have different data protection regimes that offer fewer protections for Personal Data.  

When transferring Personal Information, we take care to comply with applicable law. For example, in contexts where we transfer Personal Information collected in the EEA or UK to a country for which the European Commission or UK authorities have not granted an adequacy determination, we generally rely on standard contractual clauses (EU SCCs) adopted by the European Commission and, as applicable, the UK addendum to the EU SCCs adopted by the UK Information Commissioner’s Office, in conjunction with appropriate technical and organizational measures. Children Under the Age of Thirteen

Our Services may provide links to other websites operated by third parties. Tradewater does not control these websites and is not responsible for their data practices. Any information you provide to third parties on their websites is covered under their privacy and data collection policies and is not covered by this Policy. We urge you to review the privacy policy posted on any website you visit before using the website or providing any Personal Information. 

This Policy May Change 

We are continually improving and adding to the features and functionality of our Services. As a result of these changes or changes in the law, we may update or revise this Policy from time to time. When we do so, we will post the revised version of this Policy behind the link marked “Privacy Policy” at the bottom of each page of our website and provide any additional notice as required by applicable law. For your convenience, whenever this Policy is changed, we will update the “Effective Date” at the top of this Policy. We recommend that visitors to our Services review this Policy from time to time to learn of our new privacy practices and changes to our policies.
